Investment Discretionary Consent

WhaleHeart Capital Investment Discretionary Consent

This agreement intends to clarify the rights and obligations between the client and WhaleHeart Capital (hereinafter referred to as “the company”) in operating your investment funds. Clients participating in the funds are deemed to have agreed to both the Digital Asset Investment Risk Notice and the Investment Discretionary Consent (hereinafter referred to as “this agreement”).

Range of discretion

Clients entrust the following matters to the company.
1. Fund investment strategies and asset allocation decisions
2. Fund operation period (dissolution or extension)
3. Other ancillary duties and major decisions on fund operation

Company Obligations

Obligation to provide account and investment status information
The company transparently provides the status of cryptocurrency deposits/withdrawals, account balance, etc. and the profit and loss (P&L) status of the funds in which the customer participated through the customer dashboard that operates 24/7.

Obligation to report investment profit/loss and to return investment.
With fund completion, the company provides the operating process, verifiable settlement details including P&L, and deposits the P&L and investment principal into the Client’s WhaleHeart account excluding fees. If the client applies for asset withdrawal, the amount will be remitted to the address registered by the customer within a maximum of 74 hours.

Confidentiality obligation
The company does not share the contents of the discretionary investment service provided by the customer with any third party or external organization while operating discretionary investment business.

Obligation to report emergencies
The company alerts the customer of any emergency (hacking dangers, delistings, etc.) that may occur during operation.

Client Obligations

Clients may participate in new funds using only cryptocurrency assets that have been pre-deposited in their account.
The client must transfer cryptocurrency to the wallet address designated by the company to participate in any fund.

Fee payment
Clients agree that a portion of the fund proceeds will be paid in return for the investment services provided by the company.

Midway termination penalty
If the client requests midway fund termination, the investment principal cannot be guaranteed (termination fees and other incurred expenses are collected), and the client agrees to the balance payment period (maximum 30 days) notified by the company.

Attribution of operational results
Client agrees that principal loss of discretionary investments may occur during investment in cryptocurrency funds, and that all P&L arising from the contract property operation is attributed to the customer.
